1. About these Terms

These Terms of Use apply to the website at theyarningpress.com, including its pages, online courses, workshops, events, books, digital products, downloadable resources, community pages and other products or services offered through the website collectively referred to as the Site.

The Site is operated by The Yarning Press, an Australian sole-trader business.

In these Terms:

  • The Yarning Press, we, us and our refer to the business operating the Site;
  • User, you and your refer to any person who visits the Site, creates an account, makes a purchase, enrols in a course or workshop, submits material, or otherwise uses the Site;
  • Materials means the written, visual, audio, video, educational and downloadable content made available through the Site; and
  • Services includes workshops, courses, consultations, publishing services, community-page services and other services offered by The Yarning Press.

By accessing or using the Site, creating an account, making a purchase, enrolling in a course or workshop, or selecting a box indicating that you accept these Terms, you agree to be bound by them.

Where you make a purchase or enrolment on behalf of another person or organisation, you confirm that you have authority to accept these Terms on their behalf.

If you do not agree to these Terms, you must not use the Site or purchase its products or services.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

2. Eligibility and Users Under 18

You must be at least 18 years old to make a purchase, enter into a paid service agreement or enrol independently through the Site.

A person under 18 may participate only where:

  • the relevant course, workshop or event permits participants under 18;
  • permission has been provided by a parent or legal guardian; and
  • the parent or guardian accepts responsibility for payment and compliance with these Terms.

We may request reasonable evidence of age, identity, parental permission or authority to act on behalf of another person.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

You must not:

  • interfere with, damage or disrupt the Site or its security;
  • attempt to gain unauthorised access to the Site, another User’s account or any restricted system;
  • introduce viruses, malicious code or other harmful material;
  • scrape, harvest or systematically extract Site content or personal information;
  • use the Site to harass, threaten, abuse, defame or discriminate against another person;
  • impersonate another person or misrepresent your identity or authority;
  • use the Site or Materials for unlawful, misleading, fraudulent or commercially exploitative purposes; or
  • assist another person to do any of these things.

We may suspend or terminate access where we reasonably believe that a User has breached these Terms, misused the Site, endangered another person or interfered with the operation of a course, workshop, event or service.

Where appropriate, we will provide notice and a reasonable opportunity to respond before access is terminated.

4. Accounts and Passwords

Some courses, products and services may require you to create an account.

You are responsible for:

  • providing accurate and current information;
  • keeping your login details confidential;
  • restricting access to your account and devices; and
  • notifying us promptly if you believe your account has been accessed without permission.

Accounts and login details are for the registered User only and must not be shared, sold, transferred or made available to another person.

You are responsible for activity undertaken through your account unless the activity occurred because of a security failure for which The Yarning Press is legally responsible.

5. Courses, Workshops and Events

The description, format, date, location, duration, inclusions, participant requirements and access period for each course, workshop or event will be stated on the relevant information or booking page.

Before enrolling, you are responsible for checking:

  • the date, time and location;
  • whether the activity is online or in person;
  • any equipment or software requirements;
  • accessibility information;
  • the intended audience and prerequisites;
  • the period for which online content will remain available; and
  • the applicable price, cancellation and refund conditions.

Unless expressly stated otherwise, courses and workshops offered by The Yarning Press are educational and creative-development activities. They are not nationally recognised, accredited or certified vocational training.

Participation does not guarantee publication, commercial success, employment, funding, improved income or any particular personal or professional result.

Individual outcomes vary according to the participant’s circumstances, effort, experience and use of the information provided.

6. Participant Conduct and Workshop Safety

Participants are expected to behave respectfully towards facilitators, guests and other participants.

You must not:

  • harass, intimidate, threaten or discriminate against another participant;
  • deliberately disrupt a workshop, event or online learning environment;
  • record another participant without permission;
  • share another participant’s personal story or writing without consent; or
  • submit or present material that unlawfully infringes another person’s rights.

Writing workshops may involve discussion of personal experiences or emotionally difficult subject matter. You remain in control of what you disclose and may choose not to participate in a particular discussion or exercise.

The Yarning Press does not provide medical, psychological, legal or crisis-support services. Participants should seek appropriate professional support where needed.

We may remove a participant whose conduct is seriously disruptive, unsafe or unlawful. Where removal results from a serious breach of these Terms, a refund may not be available except where required by law.

7. Fees and Payment

Prices are displayed in Australian dollars unless otherwise stated.

You agree to pay the price shown at the time of purchase, including any clearly disclosed taxes, booking charges, delivery costs or payment-processing fees.

Payment may be processed by a third-party provider such as Stripe, PayPal, a ticketing platform or another authorised payment service. Your use of that provider may also be subject to its own terms and privacy policy.

Where a payment plan is offered, you agree to make each instalment by its due date. A payment plan divides the total fee into instalments and does not ordinarily convert the purchase into a pay-as-you-go service.

If a payment is overdue, we may temporarily suspend access after giving reasonable notice. We will not suspend or terminate access where doing so would breach applicable consumer law.

You must contact us promptly if you believe a payment has been processed incorrectly.

8. Refunds and Australian Consumer Law

Our products and services come with rights and consumer guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, repeat performance, cancellation, refund, compensation or another remedy if a product or service does not comply with an applicable consumer guarantee.

Nothing in this section limits those rights.

8.1 Change-of-Mind Requests

Unless stated otherwise on the relevant sales or booking page, we are not required to provide a refund merely because you:

  • changed your mind;
  • chose the wrong course, workshop, book or product;
  • failed to attend or complete a course or event;
  • no longer have sufficient time to participate;
  • did not use the Materials during the access period; or
  • experienced a change in personal preference or circumstances.

We may nevertheless consider a request for a refund, credit or transfer at our discretion.

Any discretionary refund or credit does not affect rights available under the Australian Consumer Law.

8.2 Digital Products and Self-Paced Courses

Because digital products and course Materials can be accessed, downloaded or copied shortly after purchase, change-of-mind refunds will generally not be available once a substantial part of the product or course has been accessed or downloaded.

Where exceptional circumstances prevent meaningful participation, you may contact us in writing. We may offer an extension, transfer, credit, partial refund or full refund depending on:

  • when the request was made;
  • how much content was accessed;
  • whether downloadable Materials were supplied;
  • costs already incurred;
  • whether another reasonable arrangement is available; and
  • the nature and evidence of the circumstances.

We will request only information reasonably necessary to assess the request. You should not send detailed medical records or other highly sensitive information unless it is genuinely necessary.

8.3 Live Workshops and Events

Unless different conditions are clearly stated on the booking page:

  • cancellation more than 14 days before the event may be eligible for a refund, less any reasonable non-refundable booking or processing costs;
  • cancellation between 7 and 14 days before the event may be eligible for a transfer or credit;
  • cancellation less than 7 days before the event will generally not qualify for a change-of-mind refund; and
  • a booking may be transferred to another suitable participant with our prior written approval.

These conditions do not limit rights under the Australian Consumer Law.

8.4 Cancellation or Rescheduling by The Yarning Press

We may cancel, postpone, relocate or reschedule a workshop or event because of illness, insufficient enrolments, venue problems, emergencies, unsafe conditions or circumstances outside our reasonable control.

Where we cancel an event and do not provide a suitable replacement, affected participants will be offered a refund of the amount paid directly to The Yarning Press.

Where an event is rescheduled or materially changed, participants may be offered a transfer, credit or refund, depending on the circumstances and applicable law.

Unless required by law, The Yarning Press is not responsible for indirect expenses such as travel, accommodation, meals, loss of income or childcare costs. Participants should consider refundable travel and accommodation arrangements.

9. Chargebacks and Payment Disputes

You should contact us first if you believe that a charge is incorrect, unauthorised or connected with a product or service that was not properly supplied.

Nothing in these Terms prevents you from exercising a lawful right to dispute a transaction or request a chargeback through your bank or payment provider.

We may provide the payment provider with relevant transaction records, enrolment information, access records, correspondence and evidence showing how the product or service was supplied.

You must not knowingly make a false, misleading or fraudulent payment dispute.

10. Intellectual Property

Unless otherwise stated, the Site and Materials are owned by or licensed to The Yarning Press and are protected by applicable copyright, trademark and other intellectual-property laws.

This includes, where applicable:

  • course and workshop content;
  • workbooks, templates and exercises;
  • written website content;
  • graphics, photographs, video and audio;
  • logos and branding;
  • downloadable files;
  • page layouts and original designs; and
  • books and other publications.

Purchasing or accessing Materials does not transfer ownership of the copyright or other intellectual-property rights to you.

Subject to any specific licence stated with a product, you are granted a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Materials for your own private learning or personal use.

You may download or print one personal working copy where downloads or printing are enabled.

You must not, without prior written permission:

  • reproduce or republish the Materials;
  • upload them to another website, course platform, shared drive or artificial-intelligence system;
  • sell, sublicense, rent or commercially exploit them;
  • share login access or downloadable Materials with another person;
  • adapt the Materials to create a competing product or service;
  • remove copyright, attribution or ownership notices;
  • record or distribute a workshop, course or consultation; or
  • provide detailed summaries, copies or reconstructions that would act as a substitute for the original Materials.

Nothing in this section prevents a use that is expressly permitted by Australian copyright law.

11. Your Writing and Submitted Material

You retain ownership of the original writing, photographs, recordings and other material you submit to The Yarning Press unless a separate written agreement states otherwise.

By submitting material through the Site, you confirm that:

  • you own it or have permission to submit it;
  • its submission and intended use do not unlawfully infringe another person’s rights;
  • it is not defamatory, fraudulent or unlawful; and
  • you have obtained any necessary consent from identifiable people.

You grant The Yarning Press only the limited permission reasonably required to receive, store, review, edit, display or otherwise handle the material for the service you requested.

We will not publish, promote or commercially exploit your unpublished writing or personal story without your permission, except where necessary to provide the requested service or where required by law.

Specific publishing, editing, restoration, digitisation, website or community-history projects may require a separate written agreement setting out copyright, permissions, attribution, confidentiality, fees, approval processes and permitted uses.

12. Community Contributions and Third-Party Content

Community pages may include information, stories, notices, photographs, advertisements or other material supplied by community members, organisations, businesses or contributors.

The contributor is responsible for the accuracy, legality and permissions associated with material they provide.

The Yarning Press may review, edit, decline, temporarily remove or permanently remove submitted content where we reasonably believe it:

  • is inaccurate, misleading, unlawful or defamatory;
  • infringes copyright, privacy, cultural rights or another person’s rights;
  • identifies a vulnerable person without appropriate consent;
  • contains harmful, discriminatory or culturally disrespectful material;
  • is no longer current or relevant; or
  • creates an unreasonable legal, cultural or safety risk.

Publication on a community page does not necessarily mean that The Yarning Press endorses the contributor, organisation, business, statement, product or service.

13. Aboriginal and Torres Strait Islander Cultural Material

The Yarning Press recognises that Aboriginal and Torres Strait Islander stories, knowledge, language, images, cultural expressions, community histories and other cultural material may carry collective rights, responsibilities and cultural authority beyond ordinary copyright ownership.

Users must not upload, reproduce, disclose, adapt, commercialise or request publication of culturally restricted, secret, sacred or community-held material without appropriate authority and consent.

Where Aboriginal or Torres Strait Islander cultural material is submitted or commissioned, The Yarning Press may require:

  • confirmation of cultural authority or community permission;
  • consultation with relevant custodians, contributors, Elders or knowledge holders;
  • agreed attribution and acknowledgement;
  • restrictions on access, copying, publication or commercial use;
  • culturally appropriate warnings or notices;
  • approval before publication or republication; and
  • procedures for correction, withdrawal or future use.

Possession of a physical document, photograph, recording or digital file does not necessarily establish cultural authority or permission to publish it.

The Yarning Press may refuse, pause or withdraw work where cultural authority, consent, ownership or appropriate use cannot be established.

Where practical, The Yarning Press will follow recognised principles for respectful handling of First Nations Cultural and Intellectual Property, including consultation, consent, attribution, benefit-sharing where appropriate, and respect for continuing cultural authority.

14. Testimonials, Photographs and Recordings

We will not use an identifiable participant’s testimonial, image, video, audio recording or personal story for advertising or promotion without permission.

Where consent is requested, the intended use will be explained. Consent may be subject to any separate written release or agreement.

Participants must not photograph, film or record another participant, facilitator or guest without permission.

General event photography may occur where this is disclosed beforehand. Participants will be given a reasonable way to indicate that they do not wish to be photographed, where practicable.

15. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy law.

The Privacy Policy explains how we collect, use, store and disclose personal information and how you may contact us about a privacy concern.

By using a third-party booking, payment, email, video-conferencing or course platform, you may also be subject to that provider’s privacy policy and terms.

16. External Links and Third-Party Services

The Site may contain links to third-party websites, platforms, resources, businesses or services.

These links are provided for information or convenience. Unless expressly stated, The Yarning Press does not control, approve or endorse third-party content and is not responsible for its availability, accuracy, security, privacy practices, products or services.

You access third-party services at your own discretion and should review their terms and privacy policies.

17. Educational Information and Professional Advice

Information provided through the Site, Materials, courses and workshops is general educational information.

It is not a substitute for legal, financial, medical, psychological, taxation, publishing-contract or other professional advice.

You are responsible for obtaining independent professional advice appropriate to your circumstances.

18. Website Availability and Technical Requirements

We take reasonable steps to maintain the Site and provide purchased content and services.

We do not guarantee that the Site will always be uninterrupted, error-free or compatible with every device, browser, internet service or third-party platform.

Access may occasionally be interrupted because of maintenance, security issues, internet outages, platform failures or circumstances outside our reasonable control.

Where a significant interruption affects a paid service, we will take reasonable steps to restore access, extend the access period or provide another appropriate remedy.

You are responsible for maintaining suitable internet access, equipment, software and security unless the relevant product description states otherwise.

19. Consumer Guarantees and Warranties

To the maximum extent permitted by law, information and general website content are provided without additional warranties beyond those expressly stated or imposed by law.

Nothing in these Terms excludes, restricts or modifies:

  • consumer guarantees under the Australian Consumer Law;
  • liability for fraud, wilful misconduct or gross negligence;
  • liability for personal injury where it cannot legally be excluded; or
  • any other right, guarantee or remedy that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by law, The Yarning Press is not liable for indirect or consequential loss arising from the use of the Site, Materials or Services, including loss of opportunity, income, business, data or anticipated savings.

Where liability can lawfully be limited, our liability will be limited, at our option, to an appropriate remedy permitted by law, which may include:

  • resupplying the relevant service;
  • paying the reasonable cost of having the service supplied again;
  • replacing or repairing the relevant product; or
  • providing a refund or other remedy required by law.

This limitation does not apply where liability cannot lawfully be excluded or limited.

21. Indemnity

To the extent permitted by law, you are responsible for loss or damage reasonably incurred by The Yarning Press because of your unlawful conduct, deliberate misuse of the Site, infringement of another person’s rights or serious breach of these Terms.

This provision does not require you to compensate The Yarning Press for loss caused by our own negligence, unlawful conduct or breach of these Terms.

22. Suspension and Termination

You may stop using the Site at any time.

We may suspend or terminate your account or access where reasonably necessary because of:

  • serious or repeated breaches of these Terms;
  • unlawful, fraudulent, abusive or unsafe conduct;
  • unauthorised sharing or commercial use of Materials;
  • a security threat;
  • non-payment after reasonable notice; or
  • discontinuation of a service.

Termination does not remove rights or obligations that arose before termination.

Any refund following termination will be determined according to the circumstances, these Terms and applicable consumer law.

23. Changes to the Site, Products and Prices

We may update Site content, product descriptions, availability and prices from time to time.

Changes to prices will not retrospectively alter the price of a completed purchase unless you agree to the change or the original price resulted from an obvious error.

Minor changes may be made to course or workshop content to improve quality, accuracy or delivery.

Where a material change affects a purchased product or service, we will provide reasonable notice and an appropriate remedy where required.

24. Changes to These Terms

We may update these Terms when our services, business practices, technology or legal obligations change.

The updated Terms will be published on this page with a revised “Last updated” date.

Changes will apply from the date they are published and will not retrospectively remove rights already accrued under an existing purchase or agreement.

Where a material change affects an existing paid service, we will take reasonable steps to notify affected Users.

Continued use of the Site after an updated version takes effect constitutes acceptance of the updated Terms for future use, but does not override rights that cannot lawfully be excluded.

25. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.

Nothing in this section prevents a consumer from exercising a right to bring a claim in another jurisdiction where applicable law permits it.

26. General Provisions

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to operate.

A delay or failure by The Yarning Press to enforce a right does not waive that right.

We may transfer our rights or obligations as part of a lawful sale, restructure or transfer of the business, provided that doing so does not reduce a consumer’s existing rights.

You may not transfer a paid account, enrolment or contractual right without our written permission, except where these Terms expressly permit a booking transfer.

These Terms, together with the Privacy Policy, relevant sales page and any separate written service agreement, form the agreement between you and The Yarning Press concerning the relevant use, purchase or service.

If there is an inconsistency, a separately signed service agreement will generally take priority for the particular service, except to the extent that doing so would unlawfully limit a consumer right.
